Flat Fee Versus Hourly Billing

 In some scenarios, flat fee billing is an attractive option.

For example, creating an operating agreement for a start-up company is typically a candidate for a flat fee. That same company may need a lease or franchise agreement review, which likewise lend themselves to a flat fee scenario. However, if those agreements ultimately require extensive negotiation before finalization, the unknown time required by the attorney may require a hybrid fee structure incorporating flat fee and hourly billing. 

Of course, there are situations, such as litigation scenarios, where hourly billing is required.
